Mattress Warehouse warrenty store credit Fraud

Hi, I bought a Beatyrest mattress from Mattress Warehouse for $1099 on Feb 18, 2024. After about a month of using it, it started diverting in the middle and we couldn’t sleep on it without horrible back pains. We applied for a warrenty claim with the store. A third party inspection was done and our warrenty was approved. However the email suggests we can get a store credit that is good for 30 days. But their website says we get a refund back the credit card used during purchase.

How can i fight this? What options do i have to get my money back?

Hi Vayy,
Welcome to the Mattress UnderGround. We are happy you are here.

Depending on your state of residence, there are several approaches to consider here.

Firstly, it’s crucial not to overlook any time limits. Make sure to send and document all responses, including a certified letter requesting a refund, and adhere strictly to deadlines.

Additionally, it’s wise to keep a printed copy of their policy as stated on their website.

Consider filing a claim in small claims court. Most filings cost less than $50 and taking this step promptly is essential. Even if the company promises to “look into it,” it’s often just a delay tactic. They usually settle once they receive notice of a court appearance.

Another avenue to explore is your State’s division of consumer affairs. Unlike the Better Business Bureau, which lacks authority to enforce refunds and solely records complaints, the Division of Consumer Affairs wields significant power in many states. While their ability to enforce refunds or payments varies from state to state, they do have the authority to impose fines.

Drawing from my experience as a board member of my state’s Division of Consumer Affairs, which aligns with my professional role as a healthcare provider, I’ve observed that most businesses prefer to address complaints rather than face fines that often exceed the original complaint’s cost.

It may take a bit of finesse on your part, but acting quickly and responsively will often get you the result you are looking for.

Hope this helps!
